The data protection authority points out that data relating to coronavirus infections (Covid-19) and suspected cases are sensitive data specially protected under data protection law.
However, data protection law also provides that this health data can be used to the extent necessary to contain the spread of the virus and to protect people. This includes, in particular, the collection of data from persons who have been diagnosed as infected or who are suspected of being infected due to contact with an infected person or due to their stay in a region at risk.
Against this background, the processing of health data may be based on Article 9 (2) (b) GDPR in conjunction with relevant provisions on the duty of care (processing for the purpose of meeting obligations under employment and social legislation).
